PERSONAL INJURY LAW IS STATE LAW. THIS WILL GIVE YOU SOME GENERAL INFORMATION ABOUT WHAT HAPPENS IN A PERSONAL INJURY CASE IN ILLINOIS. THE INFORMATION HERE IS NOT COMPLETE AND MAY BE DIFFERENT IF YOU RESIDE IN A DIFFERENT STATE. YOU MAY NEED LEGAL ADVICE.
If you are injured as a result of an automobile accident, a slip and fall accident, as a result of the negligence of a professional, or a designer manufacturer's flaw, you may be entitled to recover money from the persons and/or corporations who caused your injury. You may also be entitled to money damages to pay your hospital and/or doctors bills, any lost wages, any past and future medical expenses, any past, present and future pain and suffering, and any disability that you may received as a result of the accident.
There are typically a number of steps in handling your injury case. The first step is for you to concentrate on getting better. As soon as you are better and are no longer under a Doctor's care, we will begin ordering your medical bills and records. To help us with this, you can provide our office with all bills that are mailed to your home that are related to your injuries. While you are getting better, we will be corresponding with the Defendant and/or the Defendant's insurance company. However, until you are released from a Doctor's care, we will not be able to negotiate a final settlement. This is due in part to the amount of damages you incur. We will not know the amount of total damages you have incurred until you are completely done treating.
Once all of your medical bills and records have come in, we will review them and contact you to discuss the value of your case.
After this, we contact the defendant and/or the defendant's insurance company to discuss a possibility of settling the case. If no settlement agreement can be reached, we then prepare to file a lawsuit. This requires filing a Complaint at Law alleging the circumstances surrounding the case and the damages incurred, and having the defendant served with summons and a copy of the complaint. At that point a Judge or jury will determine how much your case is worth.
There is a Statute of Limitations in the State of Illinois requiring how soon a lawsuit may be filed after an accident. You would need to contact me personally to discuss when your individual case would need to be filed.
